ORS 107.137 is the statute that governs the best interests factors that the court considers when determining or modifying custody or parenting time. The factors include interaction with and interests in the child, relationships with other family members, the desire to continue to have a relationship with the child, whether abuse has occurred, who the primary parent is and whether each parent facilities and encourages to for the child to spend time with the other parent. These may be the primary factors, but the court may also look at the conduct of the parties, social life, marital position and other factors if they are show to harm, or may cause harm the minor child. There are also cases that have further interpreted this statute (caselaw). When in a custody and/or parenting time dispute an experienced attorney can look at all relevant facts to present your case favorably to the court.
